📍 工會「蚊型化」：16 萬工會會員消失
港府高官經常喺聯合國等國際場合，話「工會數目有增無減」嚟說好香港故事，但事實係全港工會會員 5 年內暴跌 16 萬人，跌幅逾 1/6。近三成工會申報會員僅為「個位數」，組織力量正完全瓦解，組織任何爭取勞工權益運動變得杯水車薪。
📍 「就業外勞化」：基層飯碗不保 12萬外勞大軍輸港
在缺乏獨立工會有效監督下，12 萬名外勞大軍被引入本港。以餐飲及酒店業為例，每 6 名從業員中就有一名是外勞。這導致本地基層飯碗受衝擊，失業人數較兩年前激增 60%，本地工人的議價能力與薪酬門檻已瀕臨徹底崩潰。
📍泛國安制度化 ：行政枷鎖 窒息公民社會
政權清算手段由搜捕轉化為「窒息式的行政控制」。除了至今已有15 名工會領袖被捕或檢控，《職工會條例》的修訂後，政府可無需手令即可翻查會員名單，追稅、釘牌、取消場地無日無之地發生，這種高壓環境不僅令政治性組織消亡，連「外賣員權益關注組」等純粹關注民生的組織亦被迫停辦，工運生存空間已遭全面壓縮。

最近，歌手張敬軒突然在文匯報專訪中為過去言行道歉，及表示會擔任保安局的「項目導師」；原來保安局在一至兩年前，已為反修例運動中被捕但未被檢控的人展開了一個特別項目。若被捕者展現悔意並參與「正向更生」活動，當局可考慮不予檢控。對於許多經歷了數年漫長煎熬的被捕者及其家屬來說，能夠結束無了期的心理折磨，無疑是放下心頭大石。但仔細探問，這個有條件不檢控的計劃，隱藏著對法治原則、人權及人性尊嚴的嚴重衝擊。
缺乏法律基礎 不符檢控守則
首先，這個所謂的「更生計劃」根本缺乏法律基礎，更凸顯了行政權對檢控權的僭越。有人或許會問，香港本來就有為未成年人及老年人而設的「警司警誡」計劃，以警方監管及警誡取代檢控，現在的做法有何不可？筆者認為兩者有本質的區別。警司警誡的前提是警方必須已掌握充分的檢控證據，且當事人明確承認罪行及自願接受警司警誡，警方才可根據律政司的指引，決定不提出起訴。反觀涉及反修例事件被捕而未有檢控的7000多人，警方調查已長達7年，而2025年律政司回應《集誌社》查詢時，表示早於2022年已就警方提交的反修例案件全數提供法律意見或作出指示。如果證據不足，根據香港《檢控守則》，律政司有絕對的法律責任指示警方終止調查並結案。
事實上，根據《基本法》及《檢控守則》中對「公眾秩序活動」的指引，律政司與警方面對這類案件時，更必須充分考慮涉案人士當時是否正在行使受法律保障的表達與和平集會自由。對於單純行使基本人權的市民，本就不應施以刑事檢控。
然而，保安局卻將這些理應被結案的案件武器化，倒果為因，利用警方拖延近7年的消極處理，以及受害者對隨時可被檢控的恐懼，轉化為脅迫市民接受所謂「更生計劃」的籌碼。這不僅是行政權對檢控權的公然僭越，更是將本應屬彰顯法治公正、政治中立的刑事檢控程序，降格為逼迫市民改變政治立場的勒索工具。
濫捕仍無問責
回顧過去幾年當局的說辭，更見其充滿矛盾。2022年當局曾稱「數周內」會決定這批案件的處理；但2025年人權組織和媒體的跟進報導均顯示案件依然未有結案；直到2026年的今天，當局又改口稱這個更生計劃原來已經悄悄行使了一兩年。當局刻意維持「懸而未決」的狀態，利用暴動罪等定罪門檻極低、刑罰極重（高達十年監禁）的控罪作為控制手段。這種無了期的法律威脅，不只影響當事人，亦在社會中製造了巨大的寒蟬效應。
更荒謬的是，2019年示威活動期間警方濫捕的問題，受到人權團體和國際社會嚴厲譴責，至今不但沒有正面回應、沒有官員問責，也沒有獨立調查，反而將錯就錯，利用當年濫捕所遺留下來的爛攤子，以及受害者對隨時被檢控的恐懼，包裝成今日的「恩恤」，以此作為鉗制市民的籌碼，嚴重違反《公民權利和政治權利國際公約》保障無罪假定、審訊不被無故拖延的權利。
思想自由底線
當局強調的「顯示悔意」，恐怕更是觸及了思想自由的底線。要求犯罪者對客觀的違法行為感到後悔尚屬常理，但若這份「悔意」是要求他們放棄抗議的初衷，甚至被迫改變原有的政治理念，便是對《公約》保障的思想自由（Forum Internum）的絕對侵犯。早年已有報導指，針對定罪人士的更生計劃甚至包含前往大陸的交流團、參觀國家建設，這不僅牽涉法制差異與司法管轄權的延伸，更令人質疑這究竟是為了協助更生人士融入社會，還是一種思想改造。真正的法治是懲治違法的行為，而不是控制人民的靈魂。
當政治權力試圖介入思想領域，社會便無可避免地走向一種「表態文化」。如同我們看到歌手張敬軒等公眾人物的表態，在強大的體制壓力下，逼迫個人公開譴責自己過去的信念。這種制度迫使人踐踏自己的價值觀來換取人身安全或事業生存，對當事人會造成深刻的道德損傷，更是對人格尊嚴的侮辱。
結語：免於恐懼的自由
現時最該「顯示悔意」的，其實是始作俑者的香港政府。2019年強推修例與警暴，觸發了空前的社會運動；政府對撕裂社會毫無反省，只顧污名化抗爭者、囚禁行使和平集會權利的市民。如今讓7000名被捕者結束無限期的法律煎熬，本應是修補裂痕的契機，當局卻將之變成一場政治交易——以犧牲無罪推定、侵犯思想自由、剝奪個人尊嚴為代價。當權力不受制衡，沒有人能獨善其身。今天他們可以用政治效忠來交換7000人的免於起訴，明天又會用甚麼來勒索你我的基本權利？這值得每位香港人深思。
