موضوع اصلی این است:
گرفتن گرین کارت از داخل آمریکا فقط به واجد شرایط بودن مبتنی نخواهد بود.
حتی اگر از نظر قانونی اجازه داشته باشید از داخل آمریکا برای گرین کارت اقدام کنید، اداره مهاجرت ممکن است بررسی کند که آیا پرونده شما از نظر افسر هم شایسته تأیید هست یا نه.
به زبان ساده:
واجد شرایط بودن یک موضوع است.
تأیید شدن موضوع دیگری است.
این یعنی سابقه حفظ وضعیت، کار مجاز یا غیرمجاز، تناقض احتمالی با هدف ویزا، و رفتار مهاجرتی شما از زمان ورود به آمریکا ممکن است اهمیت بیشتری پیدا کند.
اما این یادداشت، قانون جدید نمیسازد.
یک یادداشت سیاستی نمیتواند قانون را عوض کند.
نمیتواند استثناهای قانونی را حذف کند.
نمیتواند حقوقی را که قانون ایجاد کرده از بین ببرد.
