We started talking about all the restaurants and food spots that disappeared from Newburyport over the years and immediately turned into people reliving core memories.

The 10 Center Street burger. Shirley dogs at the Kmart lunch counter. Getting TCBY when frozen yogurt was peak sophistication in the late ‘80s and ‘90s.

There was just something about those places. The smell when you walked in, the weird carpeting, the little paper trays, going there with your parents after errands, running into half the town while ordering fries.

New Hampshire’s version of the MBTA Communities law officially takes effect July 1st — and it’s going to force a lot of towns to rethink what happens in aging commercial corridors and office parks.

The law requires certain communities to allow multifamily housing by right in commercially zoned areas where infrastructure already exists. But despite the panic online, it does not mean apartments can suddenly go anywhere. Towns can still exclude incompatible industrial areas, shape design standards, and create their own zoning framework around it.

We also talk about House Bill 1010, which further clarified the law and gave municipalities more flexibility in how they implement it.

Then we break down Windham’s proposed ordinance specifically, which requires:
• Buildings with at least 5 units
• Mandatory workforce housing components
• Ground-floor commercial space in some districts

Honestly, a lot of these office parks and oversized commercial zones were probably headed toward obsolescence anyway. The bigger question is whether these new zoning rules actually create attainable housing… or just more high-end mixed-use developments with better marketing.

The former Amesbury Elementary School property is officially up for redevelopment.

The vision? Multiple smaller residential buildings, a mix of housing types and sizes, pedestrian-friendly design, and a shared park or gathering space woven into the project. The rendering included in the RFP leans heavily into a Greek Revival / New England village aesthetic that’s clearly intended to tie into some of the newer nearby developments.

We get into whether that approach actually makes sense for the site… and whether something like cottage-style housing or a more organic neighborhood layout could have been a better fit instead.

Either way, this is a pretty major opportunity for Amesbury considering the location and the city’s ongoing housing discussions.

Hampton, NH just made a pretty interesting zoning change that tackles one of the biggest housing gaps we have right now: the “missing middle.”

Missing middle housing refers to the types of homes that fall between a single-family house and a large apartment complex — things like duplexes, cottage courts, townhomes, and small multifamily developments that used to exist naturally in New England towns before zoning made them nearly impossible to build. They’re typically smaller, lower-cost, and more attainable for first-time buyers, downsizers, and workforce housing.

Hampton’s new cottage court zoning allows small detached homes clustered around a shared courtyard with:
• No minimum lot size
• Homes capped at 1,250 sq ft
• Shared open space requirements
• 150 sq ft of courtyard space per dwelling

It’s a very different approach from the typical “luxury apartment complex or nothing” development pattern we’ve seen for years.

The bigger question is whether this actually creates attainable housing… or if these eventually become boutique coastal cottages selling for premium prices anyway. But regardless, it’s one of the more creative zoning changes we’ve seen locally in a long time.

Could this work in other Seacoast and North Shore communities?

Quick update on the Newburyport housing proposals since posting part one, because a lot has changed and the ordinance numbers are confusing.

There were really three separate conversations happening:

Demo delay: the separate discussion about expanding delay requirements for older homes before demolition. That is the piece tied to trying to slow teardowns of smaller older homes.

ODNC00218: the proposal to give the ZBA more authority over changes to nonconforming homes based on aesthetics, neighborhood character, and whether a project reduced the city’s supply of so-called starter homes. That proposal is now being withdrawn.

ODNC00221: the “starter home preservation” zoning amendment. This is the one with the dimensional changes. In its current form, it would reduce single-family height in R2 and R3/B3 from 35 feet to 25 feet, add a new FAR cap of.25, and loosen some lot size and frontage requirements for two-family homes while allowing them a higher FAR of.40.

Now the update since posting part one: 218 is being withdrawn, and 221 is going into a series of six workshops with residents and experts. So nothing in the current version of 221 is set in stone.

That is actually a good thing. I still think Newburyport is asking the right question, but I’m not convinced more restriction is the answer. Loosening dimensional rules for two-family homes is a step in the right direction, but if duplexes still are not allowed by right, we are not really fixing the core problem. And simply shrinking what can be built for a single-family home does not magically make housing affordable.

If the real goal is more attainable housing, the conversation needs to be much more focused on by-right duplexes, multifamily, cottage court style housing, smaller lot sizes, and better pathways to actually build modest homes.
