- find your local district court on
- make an appointment
- bring form 58.54 with you (in draft form)
- get your court date
- obtain 3 affidavits and get them notarised / complete form 58.54
- court date/ get declaration of parentage
Once you have the declaration of parentage you will be able to make an appointment with your local registry office to have your child’s birth certificate update to reflect both of their parents🎉

I’m always blown away by how shocked a room full of people can be when they hear that the majority of children of LGBTQ+ families in ireland are denied a legal connection to both of their parents.
For me this is our everyday reality - but for so many people they cannot understand how it’s 2026 and we still don’t have an equal Ireland.

Today the Minister for Health confirmed to me that she will commence Section 232 of the Assisted Human Reproduction Act on April 20th.
This new law allows people who used a known donor outside of a clinical setting before the Children and Family Relationship Act was commenced in 2020 to go to the court to obtain a declaration of parentage. I’ll post the full text of her reply to my question in my story.
This is a really important legal recognition and protection for second parents and a step forward for LGBTQ equality.
Lots more to do but good to celebrate the wins along the way. I’ll keep working on this issue until all families are recognised equally.
But over a decade on and we still don’t have what we were promised.
The majority of children born to LGBTQ+ families are still left in a legal limbo, prevented from have a legal relationship with one of their parents.
This week, after waiting months for a response, the Minister For Health, Jennifer Carroll Mac-Neil refused to meet the LGBTQ+ Parenting Alliance to discuss the legislation our family needs. In fact the only time she ever agreed to meet us was on the anniversary of Marriage Equality in May 2025.

It was deeply disappointing that the Minister for Health once again had no clear timeline or indeed commitment to publish the amending legislation. We are no clearer on how or when our children might finally be allowed a legal connection to both of their parents.

I’ve had the honour of speaking to families, organisations and legal experts in the hopes of getting to the bottom of why it’s taking so long, understanding what we need to do to fix this and pushing forward with the hope of a truly equal Ireland.
